C.      Background of the Sessions:

  1. Session 1Deliberation on the recent Supreme Court ruling on the reassessment notices

Recently, on 4 May 2022, Hon’ble Supreme Court announced judgment validating approx. 90,000 reassessment notices issued by the tax department to the taxpayers under the erstwhile section 148 of the Income Tax Act. Exercising its power under Article 142 of the Constitution of India, the Hon’ble Supreme Court has made the judgment applicable on PAN India basis and thus the judgment has far reaching impact. Join us to understand and discuss the principle laid down by Hon’ble Supreme Court, its applicability under different facts and circumstances and way forward for the taxpayers.

  1. Session 2 - Practical aspects on FDI and ODI- Banker’s perspective

In case of cross border transactions, most of the businesses have to ensure compliances with the Foreign exchange regulations and rules thereunder, as applicable in India. With India being a significant cog in the global trade, there is a considerable volume of outbound and inbound investments, trade (goods / services), other transactions happening and which needs to be in compliance with the foreign exchange regulations as governed & regulated by the Reserve Bank of India (RBI). In this context, there are many practical aspects which the businesses need to consider as most of the compliances are to be made with the Authorized Dealer (AD) banks, which have the delegated authority of the RBI. With this background and to understand the bankers perspective on both Foreign Direct Investments (Inbound) and Outbound Direct Investments (Outbound), we have the specialist FEMA team from Kotak Mahindra Bank which would dive deep into the practical aspects and this session would be of overall interest to the corporates.
