In one of our previous alerts, we informed you about the impact of the coronavirus on employment. One of the schemes of great importance in this context is that of temporary unemployment.

Temporary unemployment due to corona

Under certain conditions, the employee can benefit from benefits for temporary unemployment due to force majeure paid by the NEO. Next to the force majeure regulations, you could decide, as an employer, to place your personnel in the system of temporary unemployment for economic reasons, on the condition that you are unable to employ your staff due to the economic consequences of the coronavirus.

In the meantime, however, it has been decided to simplify the procedure for temporary unemployment: corona unemployment will be considered as force majeure in all cases as from March 13th, 2020 onwards. Therefore, a distinction is no longer made between temporary unemployment due to force majeure or for economic reasons.

It will be possible as well to apply unemployment due to corona retroactively as from March 13th, 2020 onwards. The administrative procedure will thus be greatly simplified by this measure. In addition, days of force majeure will be able to alternate with days worked.
