The Office of Attorney-General of the National Treasury (PGFN) issued Ordinance 33, on February 9th 2018, regulating the arrest of property owned by taxpayers with outstanding debts against the Treasury.

 

Now, taxpayers must pay, adhere to repayment programs, or to present a guarantee in 5 days, or to ask for a revaluation of the debt in 10 days.

 

Failure  to comply with the deadlines above gives PGFN the right to enforce several restraining measures, such as representation power before the IRS to apply penalties on dividend distribution, revoking of tax benefits, cancellation of contracts signed with the Government, revoking of special licenses, as well as to directly arrest properties owned by the debtors (without filing a lawsuit).

 

The enacted Ordinance is based on Law 13,606/2018, and it will be effective as of June.
