We would like to inform you that in the ‘Official Gazette of the Republic of North Macedonia’ no. 113/2020 from 01.05.2020 the Decree-law amending the Decree-law for implementation of the Labor Law during a State of Emergency was published.

Pursuant to this Decree-law, retroactive employment of persons whose employment was terminated in the period from March 11 to April 30 and their appropriate registration in the compulsory social security system is enabled.

The employer who deregistered the employee from compulsory social insurance in the period from March 11, 2020, to April 30, 2020, may conclude an agreement to return to work. With the agreement, the employer is obliged to settle all obligations arising from the employment relationship from the day of the employee's registration at the Employment agency until the day of concluding the agreement.

Registration in the system of compulsory social insurance of the employee at the Employment Agency of the Republic of North Macedonia is performed no later than May 7, 2020.

If the employee does not sign the agreement, the employer may register a new person in his place from the records of unemployed persons at the Employment Agency of the Republic of North Macedonia to conclude an employment contract with the same and to register him in the system of compulsory social insurance at the Employment Agency of the Republic of North Macedonia no later than May 7, 2020.

Action required

Employers who agree to retroactive employment of persons whose employment has been terminated from March 11 to April 30, will be able to do so by May 7 and thus meet the criteria and fulfill the right for using the measure of financial support for payment of salaries for the months of April and May.

This Decree-law shall enter into force on the day of its publication in the „Official Gazette of the Republic of North Macedonia“.
