With the entry into force of the labor reform (Law 2466 of 2025), mandatory hiring quotas for people with disabilities have been established for employers in Colombia. Below are the key points your company should keep in mind:
What is the requirement?
• Companies with up to 500 employees: At least 2 employees with disabilities for every 100 employees.
• Companies with more than 500 employees:
In addition to the above, they must hire 1 additional employee with a disability for every 100 employees beyond 500.
☑ This requirement is calculated based on the total number of permanent employees.
☑ It is possible to hire a greater number on a voluntary basis.
Important Requirements
• Individuals with disabilities must have official certification in accordance with the provisions of the Ministry of Health and Social Protection.
• The employer must report the contracts within 15 days of their execution through the Ministry of Labor’s platform
Enforcement and Penalties
• Compliance will be monitored by the Ministry of Labor.
• Noncompliance may result in administrative penalties.
Exceptional Cases
If, due to the nature of the position or sector, hiring is not possible, this situation must be reported to the Ministry of Labor.
Transition Period
• First year (June 25, 2025, to June 25, 2026): optional application of the percentages, with implementation of a technical review plan for reasonable adjustments.
• Starting in the second year (June 25, 2026): mandatory compliance.
✅ Recommendation: Companies are advised to conduct an internal assessment of their workforce as soon as possible and develop a compliance plan, including reasonable accommodations and a review of job profiles.
