Business Capacity  consists of the legal capacity to carry out business activity which, under the terms of the previous Commercial Code in general terms, could only be exercised by a natural person with civil capacity, that is, 21 years old.

However, under the terms of the Commercial Code approved by Decree-Law no. business companies, whether or not they have their registered office in Mozambique.

Under the terms of the aforementioned law, exceptionally minors under the age of 18 may be partners or shareholders with limited liability, however this exception only occurs in cases where the company's share capital is fully paid up for as long as the minor's business incapacity lasts.

On the other hand, while their business incapacity lasts, the minor's participation in the social bodies of society occurs through a legal representative.
