Examinership or examination is a process of attempting to formulate a survival plan for a viable insolvent company which is administered through a court process. There are strict reporting timeframes for formulating a Scheme of Arrangement to be approved by creditors and the court. We have been involved in many successful examinerships resulting in the survival of the company and the preservation of jobs. The recent changes in examinership legislation now allows smaller companies to apply for protection through the circuit court. This amendment makes examinership a viable insolvency procedure for a wider range of companies including SMEs facing financial difficulties.

In certain circumstances a Scheme of Arrangement under the improved procedure bought in by the Companies Act 2014 may be appropriate. Our professionals will advise whether this is a viable option which will depend on the specific facts of the case.
