The Malta Business Registry (MBR) has issued a Notice on the use of Electronic Signatures. It has been confirmed that electronic signatures are possible for submission of documents with the MBR as long as they adhere to EU legislation. The prevalent law in this regard is Regulation (EU) No 310/2014, hereinafter “eIDAS”.
An accepted signature is a qualified electronic signature, meaning that it must be created by a qualified electronic signature creation device having a qualified certificate issued in an EU Member State. The list of approved eIDAS Trust Service Providers in the European Union may be accessed on https://webgate.ec.europa.eu/tl-browser/#/.
Prior to submitting an electronically signed document to the MBR, one must verify the validity of the qualified electronic signature by uploading the document on https://ec.europa.eu/cefdigital/DSS/webapp-demo/validation.
