Prior to running the first payroll the entity has to be registered with all relevant authorities.  Our firm can assist in all aspects of the process from incorporation, ongoing support and compliance as well with all the necessary registrations with the Malta Financial Services Authority (MFSA), Commissioner for Revenue (CFR) and Jobsplus.

Creation of a Legal entity

The most common entity is a limited liability company and this need to be incorporated through the Registrar of Companies within the Malta Financial Services Authority (MFSA). A number of documents are required, namely the Memorandum and Articles of Association as well as the due diligence documentation Upon registration the entity is given a registration certificate and number which will be required to proceed with the registration process (for the PE number) with the authorities.

Registration of the Entity with the Commissioner of Revenue (CFR)

Any entity which is either resident or non-resident in Malta, but carries on a business activity in Malta, is required to register with the CIR. At the end of this process, the entity is provided with a Tax number which is to be quoted during the registration process with Jobsplus.

Employee work permits

In the case of Non-EU nationals, work permits are required prior to the employment of the same individuals.

Employment contracts

Employment contracts in Malta have to include the statutory conditions that are regulated by law (e.g.working hours, overtime rates, etc.). Other conditions can be agreed between the employer and the employee, as long as the minimum requirements are met.
